Legal Separation is an alternative to divorce or dissolution of marriage. It deals with the same issues as a dissolution of marriage, division of property, custody and visitation, child and spousal support. However, marital status is not terminated and the parties continue to be husband and wife.
There are a number of reasons why one may choose legal separation over dissolution including religious or other personal reasons such as the decision to retain medical insurance eligibility that would otherwise be terminated following a dissolution of marriage. Although a legal separation does not terminate the marital status of the spouses and therefore neither spouse can remarry under this judgment, a legal separation frees spouses from the rights and responsibilities of living together. After a judgment of legal separation is entered, the parties remain married in name alone.
